![]() Company's agreement to sell products to Buyer (customer) is expressly conditioned on Buyer (customer)'s assent to these Terms and Conditions. Company reserves the right to revise its Terms and Conditions at any time. Buyer (customer) is advised to keep up to date with the contents of Company's current Terms and Conditions prior to any purchase of products. It is the express wish of the parties that these... Terms and Conditions and any related documents be drafted in English. Compliance with Laws Buyer (customer) agrees to comply with all laws and regulations applicable to the purchase, transport, use, storage, sale, lease and/or disposal of the Products, including without limitation, to the extent applicable, the U.S. Export Administration Act and all regulations thereunder. Orders All orders shall be subject to acceptance by Company. Company reserves the right to cancel some or all of its entire sale of products to Buyer (customer) at any time prior to shipment. New Buyer (customers) may be requested to complete and submit a credit application, and then be approved by Company prior to placing orders. Buyer (customer) should ensure that its orders are received by Company not less than 20 working days before the requested delivery dates. Buyer (customer) orders shall be subject to these Terms and Conditions, whether or not the order so states. All sales are subject to availability of Products. Orders may not be modified or changed by Buyer (customer) unless approved in writing by Company. Price and Payment. Unless otherwise stated, prices are, and payment shall be, in U.S. Dollars. All of the Company's prices, discounts and credit policies are subject to change by Company without notice to Buyer (customer). Buyer (customer) shall not set off amounts due to Company against claims against Company. IN NO EVENT SHALL COMPANY BE LIABLE TO BUYER (CUSTOMER) OR ANY THIRD PARTY FOR ANY LOST PROFITS OR INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES DUE TO ANY PROBLEMS OR DELAYS IN SHIPMENT OR DELIVERY. Inspection, Rejection and Returns Buyer (customer) agrees to fully inspect all Products at the time of delivery. In the event that such inspection reveals any damage in the Products, Buyer (customer) shall have the right to reject such Products and, in such event, shall notify the Company and the carrier immediately of any such damage. If Buyer (customer) fails to notify the carrier and the Company in writing of any such damage within ten days of delivery, Buyer (customer) shall be deemed to have accepted the Products delivered. Such acceptance shall constitute an irrevocable acceptance of the Products by Buyer (customer) and a waiver of any and all claims Buyer (customer) may otherwise have had against the Company with respect to such Products, unless applicable to the 90 day Limited Warranty carried by all of our products. In addition, the Company must be advised of all shortages, in writing, within ten days of receipt of Products. Damaged Or Defective Items If you receive an item that is defective or damaged in transit, please immediately take a digital picture of the item and the shipping box and send it via email to order@pkolino.com.We will contact you shortly after with next steps. Change Your Mind? If you want to return the product, please contact us via email to order@pkolino.com within 10 days of receipt of the product. Please make sure that the item remains in its original condition and packaging. Returns with the original package will be refunded in the original tender less shipping fees. Sale Items Sale items are sold as-is and are final sales. Special Order Items Some items on the site are marked as "Special Order," "Custom," or "Built to Order." These items are non-returnable. |
